RESERVATIONS AND CONTRACTING:
1.1) The cost and / or reservation of the services that comprise the tour are subject to modifications, without prior notice, when an alteration to the services or changes in the exchange rates occur, due to unforseen causes.
1.2) The funds paid before the final confirmation of the services are considered as a deposit. The final confirmation of the services and the respective costs are made when the tickets are issued and / or services ordered and the corresponding billing is printed.
The final cost established according to the points above can be adjusted in cases of official increases in the transport tariffs which may affect the tour.
RESERVATIONS: Are made with the payment of the deposit, equivalent to 30% of the value of the requested services.
BALANCE: The resulting balance should be paid off 30 days prior to the start of the given services. Otherwise the company reserves the right to cancel the services without previous notice. The interested party shall not be entitled to a refund.
Eventual costs, charges, taxes and / or taxes corresponding to bank transfers or the like, used for the payment of the services, shall not be part of the total price.
2.) ALTERATIONS or MODIFICATIONS:
2.1) The company reserves the right, due to technical and operative reasons to alter totally or partially the daily order and / or the services that comprise the tour, before or during the carrying out of the same.
2.2) Exept otherwise stated, the hotels stipulated can be replaced by others of equal or higher category within the same urban area without any additional cost to the passenger. With respect to these variations, the passenger does not have the right to any form of indemnity.
2.3) The company can annul any tour under any of the mentioned circumstances that prevail in art. 24 of the decree No. 2182/72.
2.4) If for operative reasons or force majeure, the company has to suspend and / or modify the continuation of the services already initiated, the passenger has the right only to a reimbursement equivalent to those services not utilized.
Reimbursements: Claims should be presented within fifteen days after the finalization of the travel, justified by respective receipts. After this laspe of time, no claims will be accepted.
3) PRICES INCLUDE: Stay in the hotels mentioned in the itineraries or others of equal or better category, in single, double or triple rooms, etc. according to the chosen rate, with private bathroom and taxes; the eating schedule as stated for each occasion; visits and excursions mentioned; transfers to and from the airports and terminals and hotels, when indicated. The hotel accommodation begins at three o'clock and finishes at twelve o'clock the following day; regardless of the hour of arrival or departure and the full or partial use of the same; except under times otherwise expressed by the hotel. The duration of the tour is indicated in each case.
4) PRICES DO NOT INCLUDE:
4.1) Extras, beverages, laundry services, communications, boarding taxes, IVA
(Value Added Tax), visas and other taxes, actual and / or future, or any service that is not expressly indicated in the voucher issued by the travel agent.
4. 2) Foods and / or additional charges due to cancellations, transport delays in departures or arrivals, or for unforeseen reasons not related to the company.
4.3) Food provision during the transfer, except those specifically included in the programme.
5) AUTHORITY ON TOUR/ EXCLUSION FROM TOUR: The company reserves the right to exclude from the tour, at any point, any passengers whose conduct, behavior, health or other serious reasons judged by the company may provoke danger or cause discomfort to the rest of the passengers or may spoil the success of the excursion or the normal development of the same.
6) DOCUMENTATION: The passengers should adhere to the requirements of the documentation necessary to enter the country according to current legislation in each case. It is the indisputable responsibility of the agency to faithfully inform, in an anticipated manner, the requisites that the immigration, customs and health authorities demand for the destinations included in the tour, being of exclusive responsibility of the passenger to have personal documentation that the forementioned authorities demand.
Thennat Travel SA Reg. 13076 Res. 0955 is not responsible for missing personal documentation, its state or validity at the moment it is requested by the intervening Migration authorities, nor for the visa stamp process, or for the loss and / or damages that these situations may bring about.
Should the passenger not be able to enter the country or travel due to reasons mentioned above, the total of the services contracted shall be lost, without any right to claim. The same shall apply in case that the authorities of any country should refuse entry to the passenger.
7) CANCELLATIONS; MODIFICATIONS OF DATES BY THE PASSENGER:
7.1) Regarding cancellations that affect the services contracted by the agency, the refund of the same shall be subject to the conditions legally agreed upon by those who offered the services respectively. In all cases of refunds, the agency may retain the cost of the incurred expenses and a commission of 10% of the services contracted through third parties.
7.2) Once the trip has begun, the suspension, modification or interruption of the services by the passenger for personal reasons or on any grounds, does not give the right for a refund or return of any kind.
7.3) When the services contracted include transport, the cancellation or modification of the dates at the beginning of the services, are subject to the established practices of the transport companies.
7.4) In the case of non-regular air transport or charters, under any case of cancellation or modification of dates, no refund is available for the air ticket.
7.5) Cancellations and modifications are subject to the following conditions:
If notification is given with more than 30 days prior to comencement of the tour:
- 30% of the total will be held as penalty.
Within 30 days prior to commencement of the tour:
- 100% (price paid will not be refunded).
These percentages may be modified according to special conditions established by the service provider and during high season.
Reservation Costs Policy:
A charge of USD 20 for each modification of reservation is levied once initial services are confirmed.
8) CESSION AND TRANSFER: The right given to the client by the contract of tourist services, may be ceded or transferred to third parties up to 30 days prior to the date of departure, always when there is no opposition by mandate of the transport provider, hotels or service providers. When passengers are of different ages (adults - minors) the costs will be adjusted according to tariffs. In all cases of cession or transfer, the company is entitled to prescribe an added price of 10% above the agreed cost.
9) RESPONSIBILITY:
The company does hereby expressly declare that it acts solely as intermediary in the reservation and contract of the services related to or included in the respective tour or reservation of services: hotels, restaurants, transport, or other services rendered, declining all responsibility due to deficiency of whichever service, and for damages or loss that the passenger may experience to person or property whatever being the originating cause. This shall be the exclusive responsibility of the service provider.
Thennat Travel Registration No. 13076 Res. 0955, is not responsible for alterations in times, delays, and / or cancellations, facilities or equipment utilized, etc. by the transport companies and abides to the conditions stated by each of them. The responsibilities of the company, be it as a tour organizer or intermediary shall comply with the regulations contained in the International Convention on Travel Contracts passed by Law No. 19.918. The company is not responsible for situations produced by random acts or acts of God, climatic phenomena or natural events that may happen before or during the development of the tour that prevent, delay or in any way present an obstacle to the total or partial execution of the services offered by the company, conforming and abiding to the Civil Code.
With respect to air transport and that referred to luggage - both in general and carry-on - and duty free items the passenger shall adhere to the detailed conditions on the respective transport tickets, which shall constitute the only responsibility between the passenger and the transport company, in compliance to that stated by the Law 18.829 and article 14, decree 2.182/72
Thennat Travel Registration 13076 Res. 0955, is not responsible for the deterioration and / or misplacement, and / or theft, and / or loss of luggage and other personal effects of the passengers.
10) ARBITRATION CLAUSE: All questions that come about regarding the acceptance, completion, incompletion, delay or termination of the present contract, may be brought by the parts to the resolution of the Arbitration Court of the Argentine Association of Travel Agents and Tourism and / or to the Arbitration Courts (Tribunal Arbitral de la Asociación Argentina de Agencias de Viajes y Turismo y/o de los Tribunales Arbitrales) that operate in its regions. In the latter case, under said jurisdiction the contractors are subject to and give acceptance to all conditions established by the Regulation of the Arbitration Court.
11) REGULATIONS: This contract and in the services offered hereby, will abide exclusively by these general conditions, in accordance with Resolution 256/2000 of the Secretary of Tourism of the Nation, by Law N° 19.829 and its regulations and by the Brussels Convention passed by Law N° 19.918. These general conditions together with the following documentation that is given to the passenger represent the Travelers Contract as established by said Convention.
12) ACCEPTANCE OF GENERAL CONDITION:
The passenger does hereby declare to understand and accept the general conditions stated herein and said acceptance is ratified by whichever of the following acts: a) Payment in form of a reservation of the contracted services; b) Acceptance of the invoice for the services contracted; c) Through the use of any portion of any of the services contracted.
